Sales Conditions:
OFFER VALIDITY AND ACCEPTANCE:
Quotation or Perform invoice, whether electronic or in writing, relating to the sale of AKCP products and services collectively, by AKCP Co Ltd will be valid for the period of 30 days form the date of the quote. AKCP hereby objects to any terms or conditions proposed in Buyer's purchase order or other documents, which are inconsistent with, or in addition to, these Terms. All prices stated are current, subject to change without notice by AKCP. Buyer agrees to pay the price in effect at the time of shipment. Discounts, if any, will apply only on the net amount of invoices sent to Buyer after deducting transportation charges, taxes and related duties (if any), and will be allowed only if (i) the invoice is paid according to AKCP's payment terms and (ii) Buyer has no past due amounts owing to AKCP.
PAYMENT:
If order is less than $1000.00 payment will be 100% advance. (Payment may be made by credit card
or wire transfer).
If order value exceeds $1000.00 we request that payment be made by wire transfer. Invoices are due and payable within the time period noted else customer agrees to pay interest on all past-due sums at the highest rate allowed by law. AKCP, at its option, may charge Buyer 2% interest per month, on any balance not paid within the stated terms.
Orders are not subject to rescheduling or cancellation unless Buyer indemnifies AKCP fully against all costs or expenses arising in connection therewith.
SHIPMENT:
Shipments shall be by a carrier selected by AKCP unless the buyer arranges for shipment. In case of deferred delivery each shipment will have a separate invoice; shipping and handling charge will be added to each order.
Package Includes: The products as per order description, CD -ROM with software, utilities, help files, presentations, Power adapters (only USA and Canada).
AKCP in most cases will supply a power cord that matches the power outlet specification for your country. Based on the many different standards used throughout the world AKCP can not be responsible for supplying any additional adaptor that may required.
LIMITATIONS:
Performance data given in this Catalogue is provided as a guide for the user in determining suitability and does not constitute a warranty. It may represent the result of AKCP's test conditions, and the users must correlate it to actual application requirements. Actual performance is subject to the AKCP Warranty and Limitations.
HIGH RISK ACTIVITIES:
You acknowledge that the Software is not fault tolerant and is not designed, manufactured or intended by AKCP
for incorporation into products intended for use or resale in on-line control equipment in hazardous,
dangerous to life or Potentially life-threatening environments requiring fail-safe performance, such
as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control,
direct life support machines or weapons systems, in which the failure of products could lead directly to death,
personal injury or severe physical or environmental damage ("High Risk Activities"). You specifically
represent and warrant that you will not use the Software or any derivative work of the Software for High Risk Activities. |
